As far as I can tell, ROM hacking sites like SMW Central have more or less been left alone. So what is this "other story" of yours?

ROM hacks are only taken down ever because the creator had a ROM download instead of a patch avail

As I said before, the stats for fan game and ROM hack takedowns are pretty equal, with the former actually being hit more.

There is basically no more risk of a ROM hack causing any adverse publicity as compared to a fan game doing the same. And as said, it tends to be pre patched ROMs that get taken down, not just IPS patches too.

The PMBR disbanded because they foresaw Nintendo taking action, it never actually happened. Their decision was highly controversial and poorly received by the community, because they practically quit for no reason,
