So MFGG, I wanted to ask you guys something that's been bothering me for quite a while.

After AM2R and Pokemon Uranium got DMCA'd, and all the drama that ensued, I was just wondering. Considering that fangames are not not being ignored by game companies and their status as illegal content is being asserted (and copyright claims against them enforced), how do you guys, a fangame-based community, think about that? Have you ever wondered if any pet project of yours could turn into a source of legal issues for you?

I'm a big fan of derivative works, it's always cool to see where an Idea can go when it's put into different hands. Overall I think it's a good thing, and I think Nintendo is starting to as well with Mario Maker- but hopefully that doesnt mean the end of mario fan games as we know it

I used to think it'd be a big deal because of Mario Maker but nothing happened. Pretty sure MFGG is safe.

It'd be cool if Nintendo would hire people on like SEGA did some SFGHQ members! :)

IIRC the ordeal with some of the cases like No Mario's Sky weren't ad related. From what I can see it's more of a notoriety issue.

Anyone want to make a fangame especially notorious to test a theory?

Charles Martinet showed up around here once IIRC.

Maybe he stopped by to put a Cloaking Device over MFGG so that the Nintendo Lawyer Squadron couldn't find it. Bless him

i haven't worried about one of my fangames getting taken down. well, i might not be the best one to talk about this issue, considering i haven't made a fangame in a long ass time, but presuming i had been prolific at cranking these things out, i'd rather comply with a cease and desist than fight a legal battle with my limited means.

I'll admit that recent events have had me thinking less about making fangames and more about trying to adapt what fangame ideas I've had into original ideas. A Paper Mario fangame I've wanted to make (that isn't Sticker Stage) became an idea about dragons fighting robots.

Granted I've barely done anything with it but it's there.

I've noticed that usually Nintendo just goes after remakes of their games.

For example that SM64 unity title was literally Super Mario 64 but better than the version you could potentially be buying from their Virtual Console. The Super Mario Maker clones are basically the game they were currently trying to push at the time. AM2R is another case of a remake of a game Nintendo could potentially be selling on the VC. I feel that these are the games that we shouldn't be attempting.

As long as we're not trying to make bank and the games aren't direct remakes of commercially available games, Nintendo will leave us alone.


Also Nintendo doesn't pick up fangame devs because just remaking games is boring and uncreative and they don't want that. Nintendo values creativity and fresh ideas over technical ability (like the snipperclips guys). Remaking SMM or OoT in Game Maker does not really showcase technical skill or creativity, why would a developer want to hire you?
